California Applicant Privacy Notice

This California Job Applicant Privacy Notice (“Notice”) is provided by Capsule Manufacturing Inc. (“Capsule,” “we,” “us,” or “our”) to individuals who apply for employment with us. This Notice is provided pursuant to the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020 (collectively, “CCPA/CPRA”).

This Notice describes the categories of personal information we collect about job applicants, the purposes for which we use that information, how long we retain it, and your rights as a California resident.

1. Personal Information We Collect

When you apply for a position at Capsule, we may collect the following categories of personal information:

Professional / Employment Information	Resume, work history, education background, references, skills, certifications, licenses
Government ID / Protected Classifications	Information voluntarily provided as part of EEO data collection (race, gender, veteran status, disability status). Provision is voluntary.
Biometric Information	Not collected
Internet / Network Activity	IP address and usage data if you apply through our website or applicant portal
Geolocation Data	General location derived from application address or IP
Inferences	Assessments drawn from resume or interview data to evaluate fit for a role
Sensitive Personal Information	EEO voluntary disclosures only (race/ethnicity, disability, veteran status). Used solely for aggregate reporting and compliance purposes.

2. How We Use Your Personal Information

We collect and use applicant personal information for the following business purposes:

•Evaluating your qualifications and fit for open positions
•Communicating with you about your application status
•Conducting background checks and verifying credentials (upon offer, as permitted by law)
•Complying with federal, state, and local employment laws and regulations
•Compiling aggregate, anonymized EEO and workforce diversity statistics
•Protecting the safety and security of our facilities, employees, and property
•Defending against legal claims or fulfilling legal obligations

We do not sell or share your personal information with third parties for cross-context behavioral advertising.

3. How We Share Your Personal Information

We may disclose applicant personal information to:

•Internal hiring managers, HR personnel, and authorized staff involved in the recruitment process
•Background check vendors and drug testing providers (upon conditional offer, as permitted by law)
•Applicant tracking system (ATS) and recruiting software providers operating as service providers under the CCPA
•Legal counsel or government agencies when required by law or to protect legal rights

We do not sell applicant personal information and do not share it with third parties for their own independent marketing or advertising purposes.

4. Data Retention

We retain applicant personal information for a period of two (2) years from the date of application, or as required by applicable law, whichever is longer. If you are hired, your applicant information will be incorporated into your employee records and retained pursuant to our employee data retention practices.

After the applicable retention period, personal information is securely deleted or de-identified.

5. Your California Privacy Rights

As a California resident, you have the following rights under the CCPA/CPRA with respect to your personal information:

Right to Know

You have the right to request disclosure of the categories and specific pieces of personal information we have collected about you, the purposes for collection, and the categories of third parties with whom we share your information.

Right to Delete

You have the right to request deletion of personal information we have collected about you, subject to certain exceptions (e.g., completing a transaction, complying with a legal obligation).

Right to Correct

You have the right to request correction of inaccurate personal information we hold about you.

Right to Limit Use of Sensitive Personal Information

To the extent we collect sensitive personal information (EEO disclosures), you have the right to limit our use to purposes permitted under the CCPA/CPRA.

Right to Non-Discrimination

We will not discriminate against you for exercising any of your CCPA/CPRA rights. Exercising your privacy rights will have no bearing on your application or candidacy.

We will respond to verifiable requests within 45 days. We may need to verify your identity before processing a request. We will not require you to create an account to submit a request.

You may designate an authorized agent to make a request on your behalf. We may require written authorization or a power of attorney and may verify your identity directly.
